Terms & Conditions

Effective Date: June 1, 2025

These Terms & Conditions (“Terms”) govern all services provided by Amber S. King – Creative Design (“we,” “our,” “us”) to our clients (“you,” “your”). By engaging our services, you agree to these Terms.

1. Services

We provide web design, graphic design, branding, social media content, SEO, consulting, and related creative services as described in proposals, statements of work, or agreements.

2. Payments & Deposits

Web Design & Branding Projects: A non-refundable $500 deposit is required to begin work. The remaining balance is due upon project completion and before the site is transferred or made live.
Graphic Design Services: A 50% deposit is required upfront. The remaining balance is due before delivery of final digital files.
Social Media Content: Billed monthly based on content created and posted, with invoices due upon receipt.
SEO & Consulting: Invoiced hourly or project-based as agreed in advance.

Payments may be made via Melio, check, cash, or Wix Payments.

3. Cancellations & Refunds

Deposits are non-refundable once work has begun.
If a project is canceled after work has started, payments already made will be retained for completed work.
Social media campaigns may be canceled with 14 days’ written notice; any scheduled or completed posts will still be invoiced.
Refunds are not available after delivery of final digital files or launch of a website.

4. Client Responsibilities

Successful projects depend on clear communication and collaboration. To ensure timely delivery and the best possible outcome, clients agree to:

Provide Content & Materials: Supply all necessary text, images, logos, brand assets, or other materials in the requested format before or during the project as agreed.
Timely Feedback & Approvals: Respond to requests for feedback, revisions, and approvals within a reasonable timeframe (typically 3–5 business days). Extended delays in client response may result in project timeline adjustments.
Accuracy of Information: Ensure that all content, data, and materials provided are accurate, lawful, and free from third-party infringement.
Platform Access: Grant appropriate access to relevant accounts (such as Wix, social media platforms, or Google Business Profile) for the duration of the project, if required.
Communication: Maintain open and respectful communication throughout the project. Significant changes in project direction or scope must be communicated in writing.
Meeting Deadlines: Understand that failure to provide timely materials or approvals may extend project completion dates and, in some cases, result in additional fees.

5. Fees, Hosting & Third-Party Costs

Service Fees: All project pricing is based on the time and services provided by Amber S. King – Creative Design. Invoices will reflect the agreed hourly or project-based rates.
Client Responsibility for Third-Party Costs: Costs for Wix hosting plans, domain registrations, business email accounts, and any third-party apps, plugins, or subscriptions are the sole responsibility of the client. These fees are billed directly by the provider to the client.
Facilitation Support: We will assist in setting up and integrating these services into your website as part of our project work, but payment, management, and renewals of such accounts must be handled directly by the client.
Ownership: Client accounts for hosting, domains, and third-party services should remain in the client’s name to ensure full ownership and control.

6. Fulfillment & Delivery

Web Design Projects: Delivered via Wix, with account access transferred upon final payment. Basic training may be provided as part of project handoff.
Graphic Design: Final designs delivered digitally (PDF, PNG, JPG, SVG, etc.) after payment is received.
Social Media Content: Posted directly to designated platforms or provided as digital assets.
SEO & Consulting: Delivered through reports, campaigns, or strategy sessions.

7. Intellectual Property

All designs, content, and materials remain the property of Amber S. King – Creative Design until final payment is received.

Upon payment, clients receive ownership or usage rights as outlined in the project agreement. We reserve the right to display completed work in our portfolio, marketing, and promotional materials.

8. Limitation of Liability

While we strive to deliver high-quality services, Amber S. King – Creative Design is not liable for indirect, incidental, or consequential damages, including lost profits, business interruptions, or technical issues beyond our control (e.g., Wix outages, third-party service failures).

9. Revisions & Scope

Projects include up to two rounds of revisions unless otherwise agreed. Additional revisions or scope changes may incur additional fees at the hourly rate.
